Terms.
These Terms of Service govern your use of Pluribus AI Inc’s websites and products. Please read them carefully. By using our services, you agree to these terms.
Acceptance of these Terms
These Terms of Service (“Terms”) are a binding agreement between you and Pluribus AI Inc (“Pluribus,” “we,” “us”). By accessing or using our websites, applications, or other products (collectively, the “Services”), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
Description of the Services
Pluribus provides narrative-intelligence software, including the Pluribus platform, the Neighbors desktop application, and Snap, a member-polling service. The Services help users discover, monitor, and analyze public narratives and related content, and let organizations poll their own members. We may add, change, or discontinue features over time.
Accounts and eligibility
You must provide accurate information when creating an account and keep it up to date. You are responsible for activity under your account and for maintaining the security of your sign-in method. You must be at least 18 years old and the age of majority in your jurisdiction, and you must have the authority to accept these Terms on behalf of any organization you represent.
Acceptable use
You agree not to:
- use the Services in violation of any applicable law or regulation;
- infringe or misappropriate the intellectual property, privacy, or other rights of others;
- attempt to gain unauthorized access to the Services, other accounts, or our systems, or interfere with their operation;
- reverse engineer, resell, or misuse the Services except as expressly permitted.
User-sourced content and third-party platforms
Some features — including Neighbors — let you connect a third-party account or contribute content sourced from third-party platforms (for example, a neighborhood social network). You retain responsibility for any content and identifiers you choose to contribute.
By contributing such content, you represent and warrant that (a) you have the right to access that content and to contribute it to the Services; (b) your access to and use of the source platform complies with that platform’s own terms of service and applicable law; and (c) your contribution does not violate the rights of any third party. Connecting a third-party source is your choice, it is off by default, and you may disconnect it at any time. You are solely responsible for your compliance with the terms of any source platform you connect.
Snap panels
If you run a Snap panel, you represent and warrant that you have the right to contact the members you invite on the channels you use, that you will honor every opt-out promptly, and that your use of the panel complies with applicable messaging and privacy laws, including the CAN-SPAM Act and the Telephone Consumer Protection Act where they apply. You are responsible for the questions you send and for how you use and publish the results.
If you commission a question to another organization’s panel, you receive aggregate findings and a license to publish them with attribution to that panel. You do not receive member data of any kind, and you may not attempt to identify individual respondents.
Panel members are not account holders. These Terms apply to a member’s use of poll links, results pages, and other pages we provide, and our Privacy Policy explains what we collect from members and how to leave a panel.
Intellectual property and license
We (and our licensors) own the Services and all related intellectual property. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You retain ownership of content you provide, and you grant us the rights necessary to host, process, and display it in order to operate and improve the Services.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that analytical outputs are complete or accurate.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLURIBUS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
Suspension and termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Services or other users. Provisions that by their nature should survive termination will survive.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The courts located there will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to their jurisdiction and venue.
